1. Overview
MyAutoServiceAppointments.com (the “Site”) is owned and operated by Text Services, LLC (“Text Services,” “we,” “us,” or “our”), a Mississippi limited liability company. By accessing our Site or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these terms, please do not use our Site or Services.

2. The Services
Text Services provides a cloud-based appointment scheduling platform that enables auto service businesses to manage customer appointments, send appointment reminders via SMS and email, maintain customer contact lists, and perform related communication functions. Our Services are intended for lawful commercial and business use only.

We transmit appointment reminders and notifications on your behalf through third-party telecommunications carriers and email providers. While we use commercially reasonable efforts to ensure timely delivery, we cannot guarantee that every message will be delivered, as final delivery depends on factors outside our control, including carrier networks, recipient device status, and network conditions.

3. Account Registration
To use our Services, you must create an account and provide accurate, complete, and current information, including your name, business name, email address, phone number, and billing information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Text Services will not be liable for any loss or damage arising from unauthorized use of your account.

4. Multiple Locations
If your business has multiple locations, each location must set up its own MyAutoServiceAppointments.com account. A single account cannot work for more than one location, and each location will be billed separately. When multiple businesses share the same office or administrative staff, each business must maintain its own separate account for the system to function properly.

5. Permitted and Prohibited Uses
You agree to use MyAutoServiceAppointments.com only for lawful purposes and in accordance with these Terms of Use. You may not use the Site or Services for any purpose that is unlawful, abusive, or otherwise prohibited, including but not limited to:

• Sending unsolicited text messages or emails (sometimes called “spam”) to individuals who have not consented to receive communications from you
• Sending messages to individuals who have opted out or requested to stop receiving communications
• Transmitting content that violates any law, court order, or regulation
• Transmitting content that is offensive, harassing, or likely to be unwelcome to recipients
• Disrupting the MyAutoServiceAppointments.com system or interfering with other customers’ use of the Service
• Damaging MyAutoServiceAppointments.com property or infrastructure
• Transmitting adult-oriented or otherwise inappropriate content through appointment reminders or bulk email communications

You are responsible for ensuring that all contacts in your database have consented to receive SMS and email communications from your business in accordance with applicable law, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

6. Content Responsibility
You are solely responsible for all content you transmit through the MyAutoServiceAppointments.com platform, including appointment reminders, bulk email communications, and any other messages sent to your customers. Text Services provides the communication platform only and is not liable for any consequences that may arise from the content of communications sent through our Services.

You represent and warrant that you have all necessary rights, permissions, and consents to send the content you transmit through our Services and that such content does not infringe any third party’s rights.

7. Opt-Out Compliance
You are required to honor all opt-out requests promptly and in accordance with applicable law. End users may opt out of receiving SMS messages at any time by replying STOP to any message, and may opt out of email communications by using the unsubscribe link included in any email. You must process opt-out requests immediately and ensure that opted-out contacts are not contacted again through the respective channel.

Failure to honor opt-out requests is a violation of these Terms and may result in immediate suspension or termination of your account without refund. Text Services reserves the right to process opt-outs at the platform level on your behalf to ensure compliance.

8. Payment Terms

8.1 Fees and Billing
Your use of our Services is contingent upon payment of the applicable fees as described on our Site or in your service agreement. All fees are due and payable in accordance with the billing terms applicable to your account. You are responsible for providing accurate and current payment information and for paying all charges incurred under your account, including applicable taxes.

8.2 Payment Processing
Payments are processed through our third-party payment processor (Sage). By providing payment information, you authorize us and our payment processor to charge your designated payment method for all applicable fees. We are not responsible for errors or failures in payment processing caused by your payment provider.

8.3 Automatic Renewal
If you have a recurring subscription, your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. We will charge your payment method on file at the then-current rate for your subscription plan. We will provide at least 30 days’ advance notice before any price increases take effect.

8.4 Late Payments
If payment is not received when due, we reserve the right to suspend or terminate your access to the Services until payment is received.

8.5 Failed Payments
If a payment attempt fails, we may reattempt the charge and will notify you by email. Continued failure to provide valid payment may result in suspension or termination of your account.

9. Cancellation and Refunds

9.1 30-Day Satisfaction Guarantee
New customers may cancel their account at any time during the first 30 days of service without penalty. If the cancellation is within the 30-day money-back guarantee period, the monthly fee will be refunded. Please note that set-up fees are non-refundable.

9.2 Cancellation by Customer
After the 30-day guarantee period, you may cancel your account at any time. No refunds will be issued for the remaining portion of the current billing period. You may be charged for any outstanding usage incurred prior to cancellation.

9.3 Cancellation by Text Services
Text Services, LLC will terminate any account found to be abusing our system, with no refunds. Grounds for immediate termination include, but are not limited to: sending adult-oriented content, failing to honor opt-out requests, sending unsolicited messages, or any other violation of these Terms of Use.

We reserve the right to cancel any account at any time without notice for any reason we deem appropriate. Service fees paid in advance of cancellation will be prorated and refunded if we exercise our right of cancellation. However, if cancellation is caused by a violation of these Terms, no refund is due.

9.4 Effect of Termination
Upon termination or cancellation, your right to access and use the Services will cease. We may retain your data for a reasonable period following termination in accordance with our Privacy Policy, after which it will be securely deleted unless retention is required by law.

10. Intellectual Property
All content, design, graphics, software, trademarks, service marks, logos, and other intellectual property associated with the Site and Services are the property of Text Services, LLC or its licensors and are protected by applicable intellectual property laws.

By using our Service, you agree not to duplicate, copy, replicate, or reproduce any part of our platform, program, style, or ideas without express written permission from Text Services, LLC. We reserve the right to enforce our intellectual property rights at any time.

11. Limitation of Liability
Under no circumstances will Text Services, LLC be liable to you or any other person for any indirect, direct, special, punitive, incidental, or consequential damages of any character arising from your use of, or inability to use, our Services.

While appointment reminders and notifications are delivered promptly in the vast majority of cases, Text Services, LLC does not guarantee 100% delivery. Many factors outside our control — including carrier routing, network conditions, and device availability — can affect delivery. We are not liable for messages that are not delivered or that are delayed. By using our Service, you acknowledge and agree to this limitation.

12. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions.

13. Policy Updates
We may update these Terms of Use from time to time to reflect changes in our practices, legal requirements, or other factors. When we make changes, we will update the “Effective Date” at the top of this page and post the revised terms on our Site. We will also notify registered users via email sent to the address on file for your account. Your continued use of our Site or Services after the effective date of any revised Terms constitutes your acceptance of the updated terms.
